ABOUT US

Marting Law was founded in 2020 as a sole proprietorship by attorney Richelle Marting to offer a service that would combine expertise in law and reimbursement systems to support healthcare professionals and facilities. The need for this niche skill set became apparent quickly, and by 2023 Marting Law, LLC had been formed and grown to two healthcare attorneys. The team has rapidly, but strategically grown with a focus on high value services from highly qualified and passionate professionals dedicated to giving our clients the advocacy they deserve.

Our team provides support to other attorneys in consulting and expert witness capacities to help identify potential claims during dispute resolution or litigation, guide counsel during case pre-filing case due diligence, draft or edit pleadings and discovery, review discovery, or preparing formal opinions. Our team has supported other attorneys as coding, documentation, or government program rules experts during administrative hearings; offered expert testimony on matters ranging from HIPAA event, reasonableness of fees in personal injury or workers' compensation matters, payer-provider audit or contract disputes, and medical record documentation standards. Our highly qualified team has further supported clients during extensive discovery phases of disputes to compile documents for production during arbitration or litigation.

Managed Care Contract Consulting

Healthcare professionals and facilities may not have full-time, in-house managed care contracting support or may have internal resources that can benefit from additional third party guidance or support on contracting issues. We offer a team-based approach to supporting managed care contracting. By leveraging a team of professionals to support your managed care contracting, we can offer advice on contract language, help communicate concerns about payer policy changes, support negotiations through well reasoned legal analysis, and formulate step-by-step plans for managing adverse payer processes.

Our team has extensive experience in corporate compliance program design and implementation with a focus on components unique to the healthcare industry. We have multiple former compliance and privacy officers and numerous registered health information administrators ready to offer support with compliance program implementation, fractional compliance officer services, compliance event advice to investigate and document potential issues, and navigate potential reporting obligations.

Employment law and human resources matters have unique nuances in the healthcare industry. Our attorneys offer advice on employee manuals, employment policies, employee education, navigating and carefully documenting disciplinary issues, termination matters, harassment and discrimination complaint notices from state or federal agencies, FMLA support, and unemployment denial responses to state agencies.

Health Information Management Consultancy

Our team includes three prior hospital or ASC health information management directors who are also RHIAs. We not only know how to advise on HIM issues, but we know how to implement and troubleshoot them. We support facilities with fractional or prn HIM support during internal staff absences or on an ongoing basis to support a range of HIM activities. Our prior projects include EMR conversion, analysis of payer underpayments, guidance on electronic form development, chargemaster analysis, and release of information guidance.

Claims Appeals

As third party payer denials, pre- and post-payment claim reviews and audit activity increase, our experienced RHIAs and certified coders offer support with the increasing burden to review payer findings and help prepare winning appeal letters. We provide insight into trends that may illuminate opportunities for internal education, and can help communicate growing issues to facilities' managed care contracting or other teams that may warrant analysis, investigation, or escalation. Our team assists both on temporary prn projects or in longer term fractional appeals support.

Our team understands state laws for healthcare professionals' and facilities' payments when rendering care to injured workers. We help analyze payments received against those rules or applicable contract rates and pursue gaps between amounts paid and rates expected.
